Terms of Service

These Terms of Service ("Terms") govern your use of the FaxSnap mobile application ("App") and the website faxsnap.app ("Site"), operated by Echo Persona LLC ("Company," "we," "us," or "our"). By downloading, installing, or using FaxSnap, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or 16 in the EEA/UK) to use FaxSnap. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

2. Account Registration

  • You must sign in with Apple or Google to use fax features.
  • You are responsible for maintaining the security of your account.
  • You may not share your account with others or create multiple accounts.
  • You must provide accurate information during sign-in.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. The Service

FaxSnap allows you to scan or import documents, optionally sign them, and transmit them as faxes to recipients in the United States and Canada via traditional fax lines. The service relies on third-party telecommunications providers (currently Twilio) for fax transmission.

We do notguarantee that every fax will be successfully delivered. Fax delivery depends on the recipient's fax machine, phone line quality, and network conditions. We do guarantee that failed faxes will be automatically refunded to your credit balance.

4. Pricing and Payments

4.1 App Unlock

FaxSnap requires a one-time in-app purchase of $8.99 (USD) to unlock. This purchase includes 9 fax page credits and grants permanent access to all App features. This is not a subscription and will not automatically renew.

4.2 Page Credits

  • Each fax page consumes one (1) credit. Cover pages also consume one (1) credit.
  • Additional credits can be purchased as consumable in-app purchases in packs of 10, 25, 50, or 100 pages.
  • Credits never expire.
  • Credits are non-transferable between accounts.
  • Credits are tied to your account, not your device. Reinstalling the app or switching devices does not affect your balance — sign in with the same account.

4.3 Refunds

  • Failed fax refunds: If a fax fails to deliver (busy line, invalid number, transmission error), the credits are automatically and immediately returned to your account. No action is required on your part.
  • Purchase refunds: All in-app purchases are processed by Apple (App Store) or Google (Play Store) and are subject to their respective refund policies. To request a refund for a purchase, contact Apple or Google Play directly.
  • We do not offer direct refunds for purchased credits that have already been successfully used to send faxes.

4.4 Price Changes

We reserve the right to change prices for future purchases. Price changes will not affect credits you have already purchased. Current prices are displayed in the App at the time of purchase.

5. Acceptable Use

You agree not to use FaxSnap to:

  • Send unsolicited faxes, junk faxes, or spam in violation of the Telephone Consumer Protection Act (TCPA), Junk Fax Prevention Act, or equivalent laws in your jurisdiction.
  • Transmit illegal, fraudulent, defamatory, obscene, or threatening content.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Send faxes on behalf of others without their authorization.
  • Transmit content that infringes any patent, trademark, copyright, trade secret, or other intellectual property right.
  • Attempt to reverse-engineer, decompile, or disassemble the App.
  • Use automated systems, bots, or scripts to interact with the App.
  • Interfere with or disrupt the service infrastructure.
  • Circumvent any access or usage restrictions.

We reserve the right to suspend or terminate your account and forfeit remaining credits without refund if you violate these terms.

6. Intellectual Property

The App, Site, and all associated content (including but not limited to code, design, text, graphics, logos, and trademarks) are owned by Echo Persona LLC and protected by US and international copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial fax transmission purposes.

You retain all rights to the documents you fax. We claim no ownership over the content of your faxes.

7. DMCA and Content Complaints

If you believe that content transmitted through FaxSnap infringes your copyright, you may submit a DMCA takedown notice to:

Please include: (1) a description of the copyrighted work, (2) identification of the infringing material, (3) your contact information, (4) a statement of good faith belief, and (5) a statement under penalty of perjury that your notice is accurate.

8. Service Availability and Modifications

  • We strive for high availability but do not guarantee uninterrupted or error-free service.
  • We may modify, suspend, or discontinue any part of the service at any time with reasonable notice.
  • Scheduled maintenance will be announced via in-app notification when possible.
  • We are not liable for any losses resulting from service unavailability.

9. Disclaimer of Warranties

THE APP AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the service will meet your requirements; (b) the service will be uninterrupted, timely, secure, or error-free; (c) fax transmissions will always be successfully delivered; or (d) any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECHO PERSONA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, REGARDLESS OF THE THEORY OF LIABILITY.

Our total aggregate liability for all claims arising from or related to the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or fifty US dollars ($50.00), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Echo Persona LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) the content of any documents you transmit through the App.

12. Dispute Resolution

12.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at legal@faxsnap.app and attempt to resolve the dispute informally for at least 30 days.

12.2 Binding Arbitration

If informal resolution fails, any dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in the English language in the state where our principal place of business is located, or remotely at your election.

12.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, the entirety of this arbitration provision shall be null and void.

12.4 Exceptions

Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for claims related to intellectual property infringement or unauthorized access.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. For EEA/UK users, mandatory consumer protection laws of your country of residence will apply where they provide greater protection.

14. Termination

  • You may stop using FaxSnap and delete your account at any time by emailing support@faxsnap.app.
  • We may suspend or terminate your account for violation of these Terms with or without notice.
  • Upon termination, your right to use the App ceases immediately.
  • Sections 6, 9, 10, 11, 12, and 13 survive termination.

15. Third-Party Services

FaxSnap integrates with Apple, Google, Twilio, Supabase, and RevenueCat. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

16. Apple-Specific Terms

If you downloaded FaxSnap from the Apple App Store, the following additional terms apply:

  • These Terms are between you and Echo Persona LLC, not Apple. Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support for the App.
  • In the event of a failure to conform to any warranty, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claims related to the App, including product liability, legal compliance, or intellectual property infringement.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

17. Severability

If any provision of these Terms is held to be unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Echo Persona LLC regarding the use of FaxSnap, and supersede any prior agreements.

19. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Your continued use after the effective date constitutes acceptance. If you disagree with the changes, you must stop using the App and delete your account.
